Terms and Conditions of Mystic Yunnan International Travel (Hong Kong) Limited

1. Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Client”) and Mystic Yunnan International Travel (Hong Kong) Limited (“ChinaMystic”), the premier professional gateway to the “Real Westworld” of China. By booking or participating in any tour, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms govern all travel services provided by ChinaMystic, primarily focused on inbound travel to Yunnan, Xizang (Tibet), and Xinjiang.

2. Booking and Payment

1 Reservation:To make a booking, please contact us via our website, email, or other official channels. Bookings are subject to availability and formal confirmation by ChinaMystic.
2 Deposit:A non-refundable deposit is required to secure your booking. The standard deposit is 30% to 50% of the total tour cost per person. For tours involving special permits or during peak seasons, a higher deposit may be required.
3 Final Payment:The remaining balance is due 30 to 45 days prior to the scheduled departure date. Failure to pay by the due date may result in cancellation and forfeiture of the deposit.
4 Late Bookings:For bookings made within 30 days of departure, full payment is required at the time of booking.
5 Payment Methods:We offer secure online payments via industry-leading, PCI-compliant partners including Stripe, PayPal, and Airwallex. Bank wire transfers are also available, typically for larger amounts.
6 Fees:Any bank charges, credit card processing fees, or currency conversion fees associated with payments are the responsibility of the Client.

3. Cancellation and Refund Policy

Cancellations must be submitted in writing via email. As we apply professional rigor to arrange complex frontier logistics far in advance, cancellation fees apply.

1 Cancellation by the Client:Due to the nature of travel in regions like Yunnan, Xizang, and Xinjiang, the following charges apply to the total tour cost:
30 days or more prior to departure:Full refund of all monies paid, minus the non-refundable deposit.
18 to 29 days prior:15% of the total tour cost will be charged.
17 to 10 days prior:50% of the total tour cost will be charged.
9 to 4 days prior:80% of the total tour cost will be charged.
3 days or less, or no-show:100% of the total tour cost will be charged.
Note on Non-Refundables:Special permits (e.g., Tibet Entry Permit), flight/train tickets, and specific non-refundable hotel bookings are deducted in addition to the charges above.
2 Cancellation by ChinaMystic:We reserve the right to cancel a tour prior to departure for reasons such as insufficient participant numbers. In such cases, we offer a comparable alternative tour or a full refund of all monies paid to us.
3 Force Majeure:ChinaMystic shall not be liable or provide refunds for cancellations due to Force Majeure events, including natural disasters, pandemics, or government actions . We will endeavor to assist with alternative arrangements or documentation for travel insurance claims.

4. Alterations to Bookings

1 Changes by the Client:Requests to alter confirmed bookings are subject to availability and an administrative fee plus supplier penalties.
2 Changes by ChinaMystic:While we aim to operate as advertised, we reserve the right to modify itineraries due to local conditions or safety. Significant changes allow the Client to accept the change, book an alternative, or receive a refund per Section 3.2.

5. Client Responsibilities

1 Travel Documents:You are responsible for possessing a valid passport (6 months validity) and obtaining all necessary visas and health documentation. ChinaMystic provides expert assistance for special frontier permits but does not guarantee government issuance.
2 Health and Fitness:You must be in sufficiently good health for the tour. You are responsible for assessing suitability for activities above 3,000 meters and adventurous treks common in our “Double Heritage” regions.
3 Travel Insurance:Comprehensive travel insurance is mandatory. Your policy must cover trip cancellation, medical expenses (including emergency evacuation), and specifically high-altitude activities for our trekking tours.
4 Conduct:You agree to comply with the laws of China and follow the guidance of your tour leader. Disruptive, offensive, or dangerous conduct may result in immediate tour termination without refund.
5 Assumption of Risk:You acknowledge that travel to remote frontiers carries inherent risks and agree not to hold ChinaMystic liable for events beyond our reasonable control .

6. Liability and Limitations

1 Our Role:ChinaMystic acts as a professional agent in arranging services provided by independent third-party suppliers.
2 Limitation of Liability:We are not liable for any injury, loss, or damage arising from acts of third-party suppliers, Force Majeure, or Client negligence .
3 Financial Cap:Our total liability for any claim shall be limited to 100% of the total amount paid by the Client to ChinaMystic for the specific tour package .

7. Data Protection

We collect and process personal data in accordance with our Privacy Policy and applicable laws like the Hong Kong PDPO and GDPR. Booking constitutes consent to this processing for travel service purposes.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Disputes shall be attempted to be resolved amicably through negotiation or mediation (e.g., via HKIAC) before resorting to litigation in the courts of Hong Kong SAR .

9. Amendments to Terms

ChinaMystic reserves the right to update these Terms at any time. Substantial changes affecting existing bookings will be notified via email or website.

10. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
